# Assumption of Risk, Release, and Waiver of Liability

**Katrinka Sunshine LLC — Voice, Movement & Performance Coaching**

This Waiver applies to your participation in Voice, Movement & Performance Coaching sessions (“Sessions”) provided by Katrinka Sunshine LLC (“Company,” “we,” “us”). Please read carefully before your first Session. By checking the box or signing below, you agree to be bound by this Waiver in addition to the Company’s Terms and Conditions.

## 1. Nature of the Activity

Sessions may involve physical activity, including but not limited to breathing exercises, vocal warm-ups, stretching, postural work, and movement. Sessions are conducted remotely by video call, in a location of your choosing.

## 2. Assumption of Risk

I understand and acknowledge that:

– Physical activity of any kind carries inherent risks, including but not limited to muscle strain, joint injury, dizziness, vocal strain, falls, and aggravation of pre-existing conditions.
– I am voluntarily participating in Sessions with knowledge of these risks, and I freely accept and assume full responsibility for any and all risks of injury, illness, or damage, known or unknown, that I may sustain as a result of participating.
– I am solely responsible for choosing a safe physical space to participate in Sessions, free of hazards such as sharp corners, loose rugs, or insufficient clearance for movement.

## 3. Health Representation

I represent that:

– I am not aware of any medical condition, injury, or physical limitation that would make my participation in Sessions unsafe.
– If I have any medical condition, injury, pregnancy, or physical limitation, I have consulted with a licensed physician and received clearance to participate, or I am participating with the understanding that I do so at my own risk.
– I will immediately stop any activity and notify my coach if I experience pain, dizziness, shortness of breath, or any other symptom of concern during a Session.

**This Waiver and the coaching relationship do not constitute medical advice.** Katrinka Sunshine LLC is not a medical or healthcare provider. Nothing said or done during a Session is intended to diagnose, treat, cure, or prevent any medical condition.

## 4. Release of Liability

To the fullest extent permitted by the laws of the State of California, I, on behalf of myself, my heirs, executors, and assigns, hereby release, waive, discharge, and covenant not to sue Katrinka Sunshine LLC, its owners, employees, and contractors (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury that may be sustained by me while participating in Sessions, **except to the extent such loss, damage, or injury is caused by the gross negligence or willful misconduct of the Released Parties.**

## 5. Indemnification

I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost they may incur due to my participation in Sessions, to the extent caused by my own acts or omissions.

## 6. No Modification of Terms and Conditions

This Waiver supplements, and does not replace, the Company’s Terms and Conditions, including its cancellation, refund, and dispute resolution provisions, which remain in full effect.

## 7. Severability

If any portion of this Waiver is found to be unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable portion will be modified to the minimum extent necessary to make it enforceable.

## 8. Acknowledgment

**I have read this Waiver, fully understand its terms, and understand that I am giving up substantial legal rights, including the right to sue. I sign this Waiver freely and voluntarily, without any inducement.**
